Oakland man known as ‘Pistol’ to serve 16 years for manslaughter

OAKLAND — As part of a plea deal, a Bay Area man will be sentenced to 16 years in prison for killing a man at a homeless encampment in 2018, court records show.

Donte Green, 43, pleaded no contest to voluntary manslaughter in the Oct. 22, 2018 shooting death of Marcus Haynes. In exchange for his plea, prosecutors dropped a murder charge against him. Both sides agree that Green will serve 16 years in prison, with credit for the time he has spent behind bars since his arrest in 2019, court records show.

Green, who also goes by Willie Williams, allegedly shot Haynes during an argument over a phone at an encampment on 22nd Avenue and East 12th Street in Oakland. A woman who witnessed the shooting testified at Green’s preliminary hearing that she knew him by the nickname “Pistol” and that she witnessed him pull a pistol during the confrontation.

“If you’re going to pull that out just use it,” Haynes allegedly told Green shortly before the shooting.

Other eyewitnesses also identified Green, though each person had a slightly different account of the shooting and the fight leading up to it, according to a transcript of the hearing.

Green was arrested in January 2019, and all that time will count towards the 16-year sentence. His next court date has been set for Nov. 1, and he’ll remain at Santa Rita Jail in Dublin until after he is formally sentenced, court records show.
