The Washington appeals court has withdrawn its previous decision favoring Jubitz Corp. on a tax refund claim, requiring the company to reapply and navigate a more complex tax situation.
Washington Appeals Court Withdraws Ruling, Restarting Jubitz Corp.’s Tax Refund Effort
According to the report of Bloomberg Tax, on July 30, 2024, a Washington appeals court changed its earlier decision that had partly favored Jubitz Corp., a company running truck stop refueling stations. The court’s new ruling means Jubitz will need to start over in trying to get a business and occupation tax refund. Initially, the court had said the Department of Revenue was right to charge retail tax rates for fuel bought with Jubitz’s fuel cards at its network stations and wholesale rates for fuel sold to other networks.
The earlier ruling also covered transactions with people outside the network, which were not considered retail sales. This would have allowed Jubitz to get a partial refund based on these differences. However, with the court withdrawing its opinion, Jubitz now has to reapply for the refund and deal with a more complicated tax situation due to its fuel card system.
