
Federal prosecutors charged the woman with disorderly conduct and theft of government property before Trump pardoned her.
A Missouri woman who received a pardon from President Donald Trump for her role in the January 6 Capitol riot will now spend 10 years in prison for a deadly drunk driving crash.
Emily Hernandez, from Sullivan, Missouri, pleaded guilty in November 2024 to driving while intoxicated and causing an accident that killed 32-year-old Victoria Wilson and seriously injured Wilson’s husband, Ryan. The crash happened in January 2022 on Interstate 44 in Franklin County.
Police said Hernandez went the wrong way on the highway while drunk driving and crashed head-on into the Wilsons’ vehicle. Tests showed her blood alcohol content far exceeded the legal limit. Victoria Wilson’s sister later launched a GoFundMe, sharing that Victoria left behind two sons.
During her sentencing on Wednesday, Hernandez called her actions “ungodly” and said she prays for the victim’s family every day, USA Today said. The judge sentenced her to a decade in prison.
Hernandez first gained national attention for storming the U.S. Capitol on January 6, 2021. Prosecutors initially charged her with multiple crimes, including disorderly conduct and theft of government property. Later, they reduced her charges to a single misdemeanor for entering a restricted building. Photos from the riot showed Hernandez smiling and holding a broken sign from then-House Speaker Nancy Pelosi’s office.
