The lawsuit, filed on behalf of a child identified as A.B., details a nightmarish sequence of events that unfolded on November 1st at the daycare’s playground. According to legal documents, the toddler fell into a six to seven-foot-deep drain that was described by the family’s attorney as a “big watery mess of fecal matter.”

Systemic failure of supervision

Prominent Dallas attorney Levi McCathern, representing the family, emphasized the grave nature of the incident. “Defendants were responsible for ensuring its premises were safe, especially knowing well that children aged 2-6 were present and active on the premises,” the lawsuit alleges.

Traumatic discovery

When the parents arrived to pick their daughter, the child exhibited alarming signs of potential hypothermia. She was “cold to the touch, was shivering, her lips were blue, and her fingernails were blue despite now being out of the hole for some time,” court documents state.

McCathern underscored the life-threatening nature of the incident, noting that the child could have died had she been fully submerged. The drain, reportedly not fenced off, represented a critical safety hazard for young children.

Daycare’s response

Children’s Lighthouse has reportedly terminated the teacher who was allegedly responsible for the negligent supervision. The full details of the internal investigation remain undisclosed.
