UNION CITY — Most people who get arrested for alleged sexual abuse of a child either ask for their lawyer, maintain their innocence, or say nothing at all.
But Jose Valdez-Rosales apparently isn’t most people. When he was arrested in late October for alleged rampant sexual abuse, blackmail, and harassment of a 13-year-old girl over an entire year, the 36-year-old Union City resident allegedly used his police interrogation as a chance to complaint about the victim had mistreated him.
“Jose apologized to Detectives, but said he was the real victim because (Jane Doe) had initially lied about her age and then subsequently broke his heart,” Union City police Det. Dominic Ayala wrote in court filings.
Valdez-Rosales has now been charged with ongoing sexual abuse of a child, along with 12 more felonies related either to specific acts of alleged sexual abuse or possessing child pornography depicting the girl. Authorities say that Valdez-Rosales accosted the victim — who was 13 at the time — as she was walking to school, and offered her a quartz stone to help her find “true love.”
But Valdez-Rosales allegedly had even bigger plans for the girl, who would later told police that Valdez-Rosales seemed obsessed with starting a family with her, told her he wanted to get her pregnant, and refused to purchase Plan B medication for her until she “begged” him, on several occasions.
After the two met on the girl’s way to school, Valdez-Rosales learned her daily routine. Soon, he began waiting for her at a bus stop near her home, where he’d pick her up afternoons after class, then take her to his Union City home, authorities said.
Police say this occurred regularly for several months. There were allegedly also occasions where he threatened her when she initially refused his physical advances, or when he refused her asking him to stop during an act of sexual abuse.
The girl initially told Valdez-Rosales she was in high school, but later when she confessed her real age, he told her it didn’t bother her, according to police. Later, after she told him she wanted to end their “relationship,” Valdez-Rosales allegedly became obsessive and attempted to get revenge.
“Jose also left a stuffed koala bear on Victim’s front porch for he,” Ayala wrote in court filings “Additionally, Jose began sending Victim emails full of pornography. Some of the emails also included Child Sexual Abuse Material (CSAM), including photos and videos Jose had previously taken of Victim.”
This included leaving a note for the girl’s father to find that said “watch your daughter,” and tracking down the alleged victim’s new boyfriend, who was a boy her own age, according to police. He allegedly taunted the boy, telling him his girlfriend was “cheating” with Valdez-Rosales and sending child sexual abuse material to the boy that depicting Valdez-Rosales and the girl.
“Look at what your girlfriend has been doing,” one text message from Valdez-Rosales to the boy said, according to police.
Police raided Valdez-Rosales’ home, seizing lingerie and other items he allegedly bought for the girl, and took him into custody. Once inside a police interrogation room, he allegedly insisted the girl told him she was 19 when they first met. He also referred to her as the “love of my life” to explain why he continued to sexually abuse her after learning she was 13, authorities said.
Now Valdez-Rosales is in Santa Rita Jail in lieu of $100,000 bail, and is next due in court on Nov. 21 to enter a plea.
