Fifteen state attorneys general, led by Kansas’ Kris Kobach, are suing the Biden administration to block a new rule that would extend Affordable Care Act coverage to DACA recipients, arguing it violates existing laws and could create financial burdens on states.

15 State AGs Challenge Biden’s Affordable Care Act Expansion for DACA Recipients, Claiming Financial Burdens and Legal Issues

According to The Hill, a group of 15 state attorneys general, led by Kansas Attorney General Kris Kobach, is suing the Biden administration over a new rule that would extend Affordable Care Act (ACA) health coverage to immigrants who were brought to the U.S. as children. The rule, starting November 1, would let Deferred Action for Childhood Arrivals (DACA) recipients get health insurance through the Affordable Care Act. The lawsuit, filed in North Dakota, argues that this rule goes against existing laws and could burden state finances and public services.

The attorneys general say the new rule wrongly includes DACA recipients in health benefits they previously didn’t qualify for. They believe this could encourage more undocumented immigrants to stay in the U.S., creating additional financial stress on states and public systems. They are asking the court to block the rule and review its legality.

Health Officials Defend Affordable Care Act Expansion for DACA Recipients – Citing Health and Economic Benefits

Health officials say that allowing DACA recipients to use ACA coverage will help them get needed care and lower their uninsured rates. Secretary Xavier Becerra believes this will boost their health and benefit the economy and society.
