According to The U.S. Sun, $5.5 million class action settlement involving Southern Wine and Spirits aims to reimburse Americans who were unfairly charged excessive late fees on purchases of wine, beer, or liquor. Filed by Wiseman Park, LLC the lawsuit alleged that Southern Wine and Spirits imposed late fees exceeding 1% per month during a specified class period. As part of the settlement agreement Southern Wine and Spirits has committed not only to refund customers for any excessive fees they paid but also to write off unpaid late fees totaling $44.1 million. Additionally the company plans to revise its contracts to prevent similar overcharges in the future aiming to improve transparency and fairness for consumers.
Affected consumers must decide by July 25, 2024, how to handle the settlement. They can accept it passively and receive a share of the settlement automatically. Alternatively they can opt out to pursue individual claims. If they have any concerns about the settlement terms they can voice objections. Each eligible participant who stays in the class action expects to receive approximately $10. The final approval hearing is on October 15, 2024 offering a chance for stakeholders to express objections or concerns before the court’s final decision.
