Legal Precedent: New Hampshire’s 2017 Law Shapes Murder Charge for Unborn Baby’s Death

The background of the unborn baby’s tragic death case is influenced by a law from 2017 in New Hampshire. It says that babies at 5 months of development and older count as people for the law about murder. This law was signed by Republican Governor Chris Sununu. This sets a rule for the current case against Kelly. Michael Garrity who speaks for the attorney general’s office said it’s the first time someone is charged with murder for killing a baby before it’s born. Kelly is accused of two counts of second-degree murder for both Falzone and her unborn baby according to the indictment from a Carroll County grand jury. As the legal stuff goes on,there’s a meeting planned for June and a possible trial in 2025. Kelly is staying in jail without bail. His past crimes including hurting someone in 2019 make the case more complicated. Police found Falzone unconscious and not responding in the house she shared with Kelly in Ossipee. They still don’t know if Kelly is the dad of the unborn baby. This case shows how it’s tricky to decide about the rights of unborn babies and to punish crimes against pregnant people.
