WPBN: There have been over 30,000 evictions sealed across the state of Indiana since the year 2022; however, the process of sealing them can take some time.
The process would be made automatic for individuals who meet the requirements if a measure were to be passed in the statehouse. Over the past few years, sealing an eviction has been increasingly popular. This process eliminates the eviction from a person’s record.
“Every year, that number of sealings has increased,” Andrew Bradley, Senior Director of Policy Strategy at Prosperity Indiana, stated. “So, demand is picking up which tells us that people are just now learning about this. But it also means that people may not know about the process.”
The reason why Senate Bill 142 has the support of Prosperity Indiana is because of this. In the event that a person has paid off their debt or the court has ruled in their favor, the eviction would be removed from their record automatically.
“It takes a burden off of the judges because they don’t have to listen to those motions, which they are probably automatically going find for anywhere,” State Senator Liz Brown, a Republican representing Fort Wayne, stated.
In order to draft the legislation, Brown collaborated with students who were enrolled in the eviction clinic at the University of Notre Dame. This clinic offers free assistance to anyone who wish to remove an eviction from their record.
Priorities for the legislative session of 2025 are discussed among lawmakers. The students discussed with Senator Brown the difficulties that their customers are experiencing.
“Typically, their clients, it sounds like are single moms with kids,” Brown stated. “They get the eviction notice against them, turns out it’s not correct or false, but the entry is still on their record so to speak.”

It is possible that removing that from one’s record is essential in order to locate accommodation that is both safe and inexpensive.
“This is a good place for us to move forward in finding creative solutions to help make sure everyone has a safe and affordable place to live,” Bradley stated.
A bill that was passed in 2022 gives residents of Indiana the ability to request that an eviction be removed from their record.
Riches attained The state of Indiana reports that there are around sixteen other states in the country that follow similar approach. Act 142 of the Senate is now awaiting a vote from a committee.
